This Privacy Policy explains how Atomi Systems, Inc. collects, uses, shares, stores and protects personal data when You visit Our websites, purchase Our products, use Our software and online services, participate in the Verifone affiliate network for Our products, or contact Us for sales, billing or support.

This Policy applies to users of the English-language Service worldwide, including users in the European Union and European Economic Area, California, and other jurisdictions where applicable data protection laws may apply. By using the Service, You acknowledge that You have read this Privacy Policy. Where a processing activity requires consent, We will ask for Your clear and affirmative consent through an appropriate mechanism, such as a cookie consent banner, account setting, registration checkbox or similar control.

Capitalized words have the meanings defined below. These definitions have the same meaning whether they appear in singular or plural form.

Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access the Service or parts of the Service, including accounts used for software licenses, downloads, product updates or support.
  • ATOMI, Company, We, Us or Our means Atomi Systems, Inc., registered business address: No. 281, Group 1, Phu Dien Ward, Hanoi, Vietnam; Office: 15F, Viet A Building, 9 Duy Tan, Cau Giay Ward, Hanoi, Vietnam. For GDPR purposes, ATOMI is the Data Controller. For CCPA/CPRA purposes, ATOMI is the Business where that law applies.
  • Business, for the purpose of CCPA/CPRA, means the legal entity that collects Consumers’ personal information and determines the purposes and means of processing that information.
  • CCPA and CPRA mean the California Consumer Privacy Act as amended by the California Privacy Rights Act.
  • Consumer, for the purpose of CCPA/CPRA, means a natural person who is a California resident.
  • Cookies are small files placed on Your device by a website to store information about Your visit, preferences or browser activity.
  • Country refers to Vietnam.
  • Data Controller means the person or organization that determines the purposes and means of processing Personal Data.
  • Device means any device that can access the Service, such as a computer, mobile phone, tablet or similar device.
  • Do Not Track or DNT means a browser signal intended to indicate that a user does not want to be tracked across websites.
  • Privacy Contact means the Company contact point for privacy and data protection requests.
  • GDPR means the General Data Protection Regulation of the European Union.
  • Personal Data means any information relating to an identified or identifiable individual. Depending on the applicable law, this may also be called personal information.
  • Service means Our English-language website, products and related services, including https://atomisystems.com, ActivePresenter, Saola Animate, AI-powered product features where available, license management, product downloads, product updates, sales, billing, customer support activities, and the Verifone affiliate network where linked from Our English-language Service.
  • Service Provider or Processor means a natural or legal person who processes Personal Data on behalf of the Company or provides services used to operate the Service.
  • Third-party Social Media Service means any website, application or social network through which You may log in, interact with Us, send messages to Us, view Our content, or otherwise use a feature connected with the Service.
  • Usage Data means data collected automatically when You use the Service or when the Service infrastructure receives requests from Your browser or device.
  • You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual accesses or uses the Service.

Collecting and Using Your Personal Data

Types of Data Collected

Personal Data You Provide

When You register an account, purchase a product, request a license, contact support, participate in the Verifone affiliate network for Our products, ask for an education or non-profit discount, or otherwise use the Service, We may collect information such as:

  • Name, email address, phone number and contact address, including country, province or state, city and postal code.
  • Account information, such as username, hashed password, account identifiers, license keys and related account settings.
  • Order information, including products purchased, transaction amount, transaction ID, invoice details, support history and customer communications.
  • For Verifone affiliate network activity, referral or affiliate reporting data made available to ATOMI by Verifone, such as affiliate ID, referral link, referred transaction, product, amount, status and commission reporting. Affiliate registration, tax forms and payout details are handled by Verifone under Verifone’s own terms and privacy policy.
  • For education or non-profit discount requests, contact details, organization or school information, and supporting documents that You voluntarily provide.
  • Support requests, feedback, messages, attachments and other content You choose to send to Us.

For international card payments, You provide payment card or payment method details directly to the payment provider enabled at the time of purchase, currently including Verifone (formerly 2Checkout), through that provider’s checkout page. ATOMI does not store Your full payment card details.

If You use an AI-powered feature in Our products, the feature may process content that You choose to submit, such as prompts, selected text, slide or project content, generated output, attachments, images, audio, video, captions, transcripts, settings, diagnostics, provider/model selection and similar information needed to provide the feature. Where ATOMI provides or manages the AI provider integration, data You submit through the AI feature will not be used by the AI provider to train its models. You should not submit sensitive Personal Data or confidential third-party information to AI features unless You have the right to do so and accept that the selected AI provider may process it.

Usage Data

Usage Data is collected automatically when You access or use the Service.

Usage Data may include Your IP address, browser type and version, operating system, device identifiers, pages visited, referring URL, time and date of access, time spent on pages, diagnostic data, CDN and security logs, and similar technical information. Where analytics tools are used, ATOMI configures analytics processing to reduce identifiability, such as IP anonymization or truncation, where technically available.

When You access the Service through a mobile device, We may collect information such as device type, mobile operating system, mobile browser type, device identifiers, push notification tokens where applicable, and other diagnostic data needed to operate and secure the Service.

Information from Third-Party Services

If You choose to register or log in through a third-party service such as Google, We may receive the information that You allow that service to share with Us, such as display name, email address, profile image and account identifier.

If You interact with ATOMI through Facebook, Messenger, Twitter/X, YouTube or similar channels used for the English-language Service, the relevant platform processes platform data on its own infrastructure and under its own privacy policy. ATOMI only receives and processes information that You actively send to or interact with ATOMI, or administrative and analytics information the platform makes available to ATOMI for managing the relevant channel or page, such as display name, user ID, profile image, public interaction data and message content that You send to Us.

If You use the live chat widget on Our website, the live chat provider enabled by ATOMI from time to time, currently Tawk.to, may process information such as Your name and email address if You provide them, chat messages, IP address, browser and device information, pages visited and other technical data needed to operate the chat service. Tawk.to’s privacy policy is available at https://www.tawk.to/privacy-policy.

Sensitive Personal Data

ATOMI does not intentionally request sensitive personal data such as health information, biometric data, political or religious views, detailed financial status or similar sensitive categories through the English-language Service. If You voluntarily include sensitive information in support content or messages, We will handle it under data minimization principles and delete it when it is no longer needed.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

  • To provide and maintain the Service: create and manage accounts, issue and manage software licenses, provide updates, deliver online functions and monitor Service performance.
  • To perform a contract: process orders, payments, license delivery, warranty, support, product-affiliate reporting where applicable, and other contractual obligations.
  • To contact You: send order status, license information, service messages, security updates, support responses and other communications related to the Service.
  • To provide customer support: answer questions, resolve complaints, troubleshoot technical issues and improve support quality.
  • To provide AI-powered features: process content You submit to AI features, generate outputs, connect to selected AI providers, apply provider/model settings, troubleshoot errors, improve feature reliability and enforce usage limits or abuse-prevention rules.
  • To comply with legal obligations: keep accounting and tax records, respond to lawful requests, prevent fraud and maintain legally required business records.
  • To analyze and improve the Service: measure website traffic, understand feature usage, diagnose issues, improve user experience, and develop or improve products and services.
  • To send marketing communications: send newsletters, product updates or offers only where You have subscribed or otherwise consented, and allow You to unsubscribe at any time.
  • To secure the Service: detect, prevent and investigate fraud, abuse, spam, bot activity, attacks, policy violations or other harmful activity.
  • For business transfers: evaluate or conduct a merger, reorganization, sale of assets or similar transaction, subject to appropriate notice and safeguards where required.

Depending on Your jurisdiction and the specific processing activity, ATOMI relies on one or more of the following legal bases:

  • Performance of a contract: for account creation, order processing, license delivery, support and product-affiliate reporting where applicable.
  • Consent or user instruction: for optional AI-powered features where You choose to submit content to a selected AI provider or configure a provider for that feature.
  • Legal obligation: for tax declarations, accounting record retention, lawful requests and similar compliance requirements.
  • Consent: for non-essential cookies, analytics, advertising cookies, some marketing communications and other processing that requires consent.
  • Legitimate interests: for security, fraud prevention, service improvement, business administration and direct marketing where permitted by law and where Your rights do not override those interests.

Sharing of Your Personal Data

We may share Personal Data in the following situations:

  • With Service Providers and Processors: to host infrastructure, operate email, analytics, CDN or traffic-protection services where applicable, support and live chat, payment, security, AI-powered product features, AI-assisted internal workflows, social media communication, notification and similar services.
  • With payment and banking providers: to process payments, reconcile transactions, issue refunds, detect fraud and keep accounting records.
  • With public authorities: where required by law, court order, tax authority request or other valid request from a competent authority.
  • For business transfers: in connection with a merger, acquisition, financing, reorganization or sale of assets, subject to appropriate safeguards.
  • With Your consent: for any other purpose that We disclose to You and for which You give consent.

ATOMI does not sell Personal Data in the ordinary commercial meaning of selling customer data for money. Some advertising and analytics technologies, such as Google Tag Manager, Google Analytics or advertising tools enabled by ATOMI from time to time, may be considered a “sale” or “sharing” under certain privacy laws. Where applicable, You can opt out through cookie preferences or by contacting Us.

Service Providers and Cross-Border Transfers

International Service Providers

We use service providers and technology platforms that may process Personal Data outside Vietnam and/or outside Your country or region, including in the United States and the European Union. Depending on the Service, these provider categories may include:

  • Cloud infrastructure, hosting, CDN, traffic acceleration, website security and abuse-prevention providers.
  • Business email, transactional email, notification, customer communication and support providers.
  • Analytics, advertising measurement, tag management, cookie-related technologies and embedded media providers, where enabled and where You have consented when required.
  • AI provider platforms and language-processing APIs for AI-powered product features or AI-assisted internal workflows, where available and configured.
  • Payment, order processing, fraud-prevention, affiliate-network and reconciliation providers for purchases and product-affiliate reporting.
  • Social media, messaging, live chat and other customer-support channels that You choose to use when contacting or interacting with ATOMI.
  • Product delivery, license management, account, authentication, update and notification services used to operate the Service.
  • Professional, legal, accounting, compliance, security and other business-administration service providers where needed for ATOMI’s legitimate business operations or legal compliance.

We maintain appropriate contractual, technical and organizational safeguards with these providers where applicable, such as data processing agreements, standard contractual clauses where relevant, access controls, security commitments and incident notification terms.

Verifone operates its payment gateway and affiliate network as an independent service provider or independent controller for information You submit directly to Verifone. ATOMI receives only the order, transaction, referral or reporting information needed to deliver products, reconcile purchases, handle support and administer product-affiliate reporting.

When an AI-powered product feature uses a third-party AI provider, the provider may receive and process the content You submit to that feature and related technical data. For AI integrations provided or managed by ATOMI, submitted content is not used by the AI provider to train its models. If a product lets You configure Your own provider account or API key, Your use of that provider is also governed by the provider’s own terms, privacy policy and data controls.

Payments

International Payments

ATOMI uses international payment providers enabled from time to time, currently including Verifone, Inc. (formerly 2Checkout), for international customers. When You purchase through the English website, You may be redirected to the payment provider’s checkout page to enter credit card, debit card or other payment details supported by that provider and enabled by ATOMI at that time.

ATOMI does not store full card information. Payment details are submitted directly to the payment provider and handled under that provider’s security and privacy practices, including applicable payment-security standards. ATOMI receives order completion information such as purchaser name, email address, address, country, product, amount and transaction ID.

Tracking Technologies and Cookies

We use Cookies and similar technologies to operate the Service, remember preferences, measure traffic, protect forms from abuse and, where You consent, support advertising and remarketing.

  • Necessary / Essential Cookies: required to provide core website functions, authentication, security, fraud prevention and requested services.
  • Functionality Cookies: remember choices You make, such as language, display preferences or account-related settings.
  • Analytics Cookies: help Us manage analytics tags and understand website traffic and usage, such as through Google Tag Manager and Google Analytics. These are activated only after consent where required.
  • Advertising and Targeting Cookies: help measure advertising effectiveness and support remarketing, such as through Google Ads or similar advertising tools enabled by ATOMI from time to time. These are activated only after consent where required.
  • Social Media Cookies: may be set when You interact with embedded content, social buttons, Facebook, Twitter/X, YouTube or similar platforms, subject to Your consent and the platform’s own privacy practices.

Our website may show a cookie consent banner when You first visit. Non-essential cookies are activated only after You consent where consent is required. You may change Your choice through the cookie settings link on the website where available, or through Your browser settings.

Opting Out of Analytics and Advertising

You do not need a separate ATOMI account to opt out of non-essential analytics or advertising cookies. Where the cookie banner or cookie settings link is available, You can reject or change non-essential cookie choices there. You may also use browser settings or privacy extensions to block cookies and tracking technologies.

If You are a California resident and want to submit a “Do Not Sell or Share My Personal Information” request, You may email support@atomisystems.com with that request. If ATOMI adds a dedicated preference link later, You may use that link as well.

YouTube Embeds and Anti-Bot Tools

ATOMI embeds YouTube videos using YouTube’s privacy-enhanced mode, such as youtube-nocookie.com, where available. For embedded videos on ATOMI websites, when You actively play an embedded video, Your browser may send IP address, browser/device information and related playback data to Google. When You visit ATOMI’s YouTube channel directly, subscribe, view, comment or otherwise interact on YouTube, Google/YouTube processes data on its own platform under Google’s privacy policy; ATOMI only receives interaction information or channel analytics made available to channel owners.

ATOMI may use anti-spam, anti-bot or abuse-prevention tools enabled from time to time, currently including Cloudflare Turnstile, to protect forms and website functions. These tools may process technical signals such as IP address, browser and device information and interaction signals needed to verify a legitimate request. They are used for essential security purposes and not for advertising or marketing tracking.

Do Not Track

Our Service does not currently respond to Do Not Track browser signals because these signals are not standardized. You can manage tracking through Our cookie consent tools where available and through Your browser or device settings.

Retention of Your Personal Data

ATOMI keeps Personal Data only for as long as necessary for the purposes described in this Policy or as required by law. Typical retention periods include:

  • Customer account and license data: while the account, contract or customer relationship remains active, plus up to 5 years where needed for warranty, support, legal or business records.
  • Payment and reconciliation records: according to provider policies and ATOMI’s accounting record retention requirements, generally retained as long as needed for tax, accounting, dispute handling and legal compliance.
  • Analytics data: according to the configuration of the analytics tool used and only for as long as needed for the disclosed analytics purpose, unless a shorter or longer period is required or allowed for a specific lawful purpose.
  • Email delivery logs: according to provider policies and applicable retention settings, typically retained only as long as needed to deliver email, troubleshoot, handle support, investigate abuse or meet legal requirements.
  • Business email: retained under Our email and workspace policies, provider terms and applicable backup or recovery settings.
  • CDN, traffic-protection and security logs: retained for a short period necessary for operation, security analysis, abuse prevention and diagnostics, or according to provider policies.
  • AI API prompts, submitted content and responses used for product AI features or internal workflows: ATOMI does not intentionally store these long term as customer records unless needed to provide the feature, troubleshoot, enforce usage limits, handle support or meet legal requirements; providers may retain API data for a limited period for safety or abuse monitoring under their terms.
  • Live chat transcripts and metadata: retained according to ATOMI’s support needs and the live chat provider’s retention settings and policies.
  • Social media, messaging and video-platform interactions: retained according to the platform’s own policies. ATOMI may retain copies where needed for customer support, compliance or dispute handling.

When data is no longer needed, ATOMI will delete, anonymize or securely dispose of it where legally and technically possible.

Security of Your Personal Data

ATOMI applies technical and organizational measures designed to protect Personal Data against unauthorized access, use, disclosure, alteration or destruction. These measures may include protecting data in transit, applying appropriate safeguards for sensitive data at rest, access controls based on role and legitimate processing need, system or access logging where appropriate, traffic-protection and anti-abuse controls, anti-bot tools where enabled, staff guidance or training, and security reviews based on operational needs, risk and applicable legal requirements.

No method of transmission over the Internet or electronic storage is completely secure. ATOMI applies safeguards appropriate to the nature, scale and risk of the processing, but We cannot guarantee absolute security in every circumstance.

Data Breach Notification

If ATOMI becomes aware of a personal data incident involving leakage, loss or unauthorized access, We will assess the incident and take appropriate remedial steps. Where required, We will notify the relevant GDPR supervisory authority, affected individuals, and other authorities or parties within the time limits required by applicable law, including 72-hour notification where applicable.

Your Data Protection Rights

General Privacy Requests

Depending on Your location and the applicable law, You may request access to, correction of, deletion of, or a copy of Personal Data that We hold about You. You may also ask Us to stop sending marketing emails, withdraw consent where processing is based on consent, or object to certain processing where the law gives You that right.

You can make a request by contacting support@atomisystems.com or by using account settings where available. We may ask You to verify Your identity or authority before responding. We may also deny or limit a request where the law allows or requires Us to keep the data, such as for security, fraud prevention, accounting, tax, dispute handling or legal compliance.

GDPR Privacy

If You are in the EU or EEA, You may have rights under GDPR, including the right of access, rectification, erasure, restriction, data portability, objection, withdrawal of consent, and the right not to be subject to certain decisions based solely on automated processing. You also have the right to lodge a complaint with a supervisory authority in the EU/EEA member state where You live, work or where an alleged violation occurred.

For GDPR requests, please contact support@atomisystems.com. ATOMI will respond within 30 days where GDPR applies, unless an extension is permitted by law.

Transfers involving EU/EEA data and providers outside the EU/EEA may rely on standard contractual clauses and appropriate supplementary safeguards where required.

CCPA/CPRA Privacy Notice (California Privacy Rights)

If You are a California resident, You may have the right to know what categories of personal information We collect, the sources of that information, the purposes for collection, use, disclosure or sharing, the categories of third parties with whom We share it, and the specific pieces of personal information We collected about You.

In the preceding 12 months, ATOMI may have collected the following categories of personal information, depending on how You used the Service:

  • Identifiers: name, email address, phone number, account ID, IP address, device identifiers, license identifiers, transaction identifiers and similar identifiers.
  • Customer records information: billing contact information, purchase records, support communications and other information You provide in connection with an order or request.
  • Commercial information: products purchased, considered or licensed, transaction amount, order status, referral or affiliate reporting data, and customer support history.
  • Internet or network activity: pages visited, referring URLs, browser and device information, cookie identifiers, analytics events, advertising events, CDN, traffic-protection or security logs and similar usage data.
  • User-submitted content: support messages, live chat messages, AI prompts, files, project content, transcripts, generated output and similar content that You choose to submit to the Service.
  • Geolocation information: approximate location inferred from IP address, such as country or region.
  • Inferences: limited product-interest or marketing-segment inferences derived from website activity or purchase history, where advertising or analytics cookies are enabled.

We collect this information directly from You, automatically from Your browser or device, from Service Providers such as analytics, email, hosting, security, live chat, AI and payment providers, and from payment or affiliate-network providers where they provide order, transaction or affiliate reporting information for Our products.

We disclose personal information to Service Providers and relevant third parties for the purposes described in this Policy, including hosting, email delivery, analytics, advertising measurement, payment processing, fraud prevention, live chat and customer support, AI-powered product features, security, product delivery, legal compliance and business administration.

You may also have the right to request deletion, request correction, limit the use or disclosure of sensitive personal information, opt out of sale or sharing of personal information, and not be discriminated against for exercising Your rights.

ATOMI does not sell Personal Data for money and does not knowingly sell or share personal information of children under 16. Some advertising or analytics tools, including Google Tag Manager, Google Analytics or advertising tools enabled by ATOMI from time to time, may be considered sharing under CCPA/CPRA when they are used for cross-context behavioral advertising. You can opt out by rejecting advertising cookies in Our cookie banner, using the opt-out options listed in this Policy, adjusting Your advertising settings on the relevant platform, or emailing support@atomisystems.com with the subject “Do Not Sell or Share My Personal Information – CCPA Request”.

ATOMI will verify Your identity before processing a CCPA/CPRA request and will respond free of charge within 45 days where required by law. This period may be extended once by an additional 45 days where reasonably necessary and with notice.

California Shine the Light Law

California residents with an established business relationship with Us may request information once per year about sharing of Personal Data with third parties for the third parties’ direct marketing purposes. Please contact support@atomisystems.com.

California Privacy Rights for Minor Users

California residents under the age of 18 who are registered users of online services may request removal of content or information they publicly posted. To request removal, contact support@atomisystems.com and include the email address associated with Your account. Removal may not be complete where the law does not require or permit complete removal, or where third parties have copied or stored the content.

Children’s Privacy

Our Service is not directed to children under 13. We do not knowingly collect personally identifiable information from anyone under 13. If You are a parent or guardian and believe that Your child has provided Us with Personal Data, please contact Us. If We learn that We collected Personal Data from a child under 13 without appropriate consent, We will take steps to delete that information.

Social Media, YouTube and Third-Party Links

Facebook Fan Page and Messenger

ATOMI operates the official ActivePresenter Facebook Page at https://www.facebook.com/ActivePresenter/. When You visit, follow, like, comment or otherwise interact directly on the Page, Meta Platforms, Inc. processes data on the Facebook platform under Meta’s privacy policy. ATOMI does not control Facebook’s infrastructure, cookies, user accounts or platform data collected by Meta.

ATOMI only receives and processes content or interactions that You actively send to ATOMI, and administrative or analytics information Meta makes available to ATOMI for managing the Page. ATOMI and Meta Platforms, Inc. may be joint controllers for certain Page Insights data under Meta’s Page Insights terms.

When You message ATOMI through Facebook Messenger, the message is processed through Meta’s platform. ATOMI may respond through the relevant platform management tools and may retain copies of the conversation where needed for customer service, dispute handling or legal compliance.

YouTube and Twitter/X

ATOMI operates official YouTube and Twitter/X channels to publish product information, tutorials and marketing content. When You subscribe, view, comment, follow, message or otherwise interact directly with those platforms, the platform provider processes Your data under its own privacy policy. ATOMI does not control those platforms’ infrastructure, cookies, user accounts or platform data; ATOMI only receives information You actively send to or interact with ATOMI and administrative or analytics information made available to channel/account owners.

Our Service may contain links to websites or services not operated by ATOMI. If You click a third-party link, You will be directed to that third party’s site. We recommend that You review the privacy policy of every site You visit. We are not responsible for the content, privacy policies or practices of third-party sites or services.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in Our services, legal requirements or data processing practices. We will post the updated Privacy Policy on this page and update the “Last updated” date above.

If a change materially affects Your rights or how We process Your Personal Data, We will provide additional notice where required, such as by email or a prominent notice on the Service before the change becomes effective.
